Patna High Court

Himanshu Kumar @ Himanshu SinghversusThe State of Bihar

Decided
Disposal
DISMISSED

Holding

Regular bail was denied because the offence is grave, the petitioners were directly involved, and their self‑incriminatory statements indicated a high risk of tampering with evidence or influencing the trial.

Summary

The petitioners, Himanshu Kumar (alias Himanshu Singh) and Niraj Kumar Nayan (alias Bittu Kumar), were charged under Section 103(1) of the Bharatiya Nyaya Sanhita, 2023 for the brutal murder of a deceased person whose neck was cut. CCTV footage placed both accused at the scene and showed them purchasing the murder weapon, with the payment made by Niraj Kumar. Both accused gave self‑inculpatory statements describing the killing and have been in custody since 8 September 2025. The learned Single Judge considered the heinous nature of the offence, the direct participation of the petitioners, and their admissions. In view of these circumstances, the Court declined to grant regular bail. The order expressly states that the observations are prima facie and do not prejudice the trial.

Issues considered

  • Whether regular bail can be granted to accused persons under Section 103(1) of the Bharatiya Nyaya Sanhita, 2023 when the offence is heinous, the accused are directly involved, and have made self‑incriminating statements.
