The court granted regular bail to the petitioner.

Summary

The petitioner, Ranjeet Mahto, was arrested in connection with an alleged assault on an informant involving a lathi, iron rod and daab, leading to a head injury. He faced charges under IPC sections 341, 323, 324, 307, 379, 504, 506 and 34. The petitioner contended that the FIR was vague, the injury was minor, and he had no role in the alleged offences, seeking regular bail after being in custody since 15 September 2025. The State opposed the bail on the seriousness of the charges, especially attempt to murder. After hearing both sides, the court found no compelling reason to deny bail and ordered the petitioner released on a bail bond of Rs.10,000 with two sureties, directing compliance with the A.C.J.M. at Chapra.

Issues considered

  • Whether the petitioner is entitled to regular bail pending trial for offences including attempt to murder and other IPC charges.
  • Whether the nature of the alleged assault and the minimal injury justify denial of bail.
  • Whether the petitioner’s prior criminal antecedent affects the grant of bail.
