Patna High Court

Md. MerajversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted regular bail to the petitioner subject to a bond of Rs.10,000, two sureties, and weekly police‑station attendance.

Summary

The petitioner, Md. Meraj, was arrested in connection with a case under sections 25(1‑B)a and 26 of the Arms Act after a pistol and three live cartridges were recovered from his possession. He had been in custody since 27‑10‑2025 and also faced six other criminal cases. The petitioner applied for regular bail, arguing that the nature of the allegation and the length of his custody warranted release. The High Court considered the seriousness of the arms offences, the custody period, and the petitioner’s right to liberty, and decided to grant bail. Bail was conditioned on a Rs.10,000 bond with two sureties and a requirement to appear at the police station every Sunday, with a warning that non‑appearance would lead to cancellation of bail.

Issues considered

  • Whether regular bail should be granted to a person accused under sections 25(1‑B)a and 26 of the Arms Act.
  • Whether the conditions imposed (bond, sureties, weekly police‑station attendance) are sufficient to justify bail.
