The anticipatory bail application is not entertainable and is dismissed.

Summary

The petitioner, Anvar Khan, sought anticipatory bail fearing arrest in a dowry harassment case (Mahila P.S. Case No. 04 of 2025) alleging demand for Rs. 2,00,000 and cruelty leading to his wife’s ouster. The prosecution alleged that Khan, after marrying under Muslim law, demanded dowry and subjected his wife to cruelty, invoking sections of the B.N.S. and the Dowry Prohibition Act. Khan contended he is a daily‑wage worker, denies any wrongdoing, and claimed he already enjoys the privilege of Section 35(3) of the B.N.S., rendering anticipatory bail unnecessary. The court observed that the allegations were general, the application was premature, and the privilege claim did not preclude the need for bail. Consequently, the court dismissed the anticipatory bail application, directing the petitioner to re‑apply if apprehension of arrest later arises.

Issues considered

  • Whether the anticipatory bail application is maintainable at the present stage.
  • Whether the petitioner is entitled to the privilege under Section 35(3) of the B.N.S. to bar anticipatory bail.
