Upendra Singh @ Upendra Narayan SinghversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court granted anticipatory bail to the petitioner.

Summary

The petitioner, Upendra Singh, sought anticipatory bail fearing arrest in a case (Surajgarha PS Case No.279 of 2024) involving alleged offences under the Bharatiya Nyaya Sanhita, 2023 and the Arms Act. The prosecution alleged that co‑accused assaulted an informant with a sword and that the petitioner, along with four others, assaulted the informant’s mother with a revolver. The petitioner contended he was falsely implicated, that no specific allegation of assault was made against him, and that any injury was minor. The State opposed the bail application. The Court observed the lack of a specific charge against the petitioner and noted that a co‑accused had already been granted anticipatory bail, and therefore granted anticipatory bail to the petitioner subject to bail bonds, sureties and conditions under Section 482(2) of the Bhartiya Nagarik Suraksha Sanhita.

Issues considered

  • Whether anticipatory bail should be granted in the absence of a specific allegation of assault against the petitioner
  • Whether the provisions of Section 482(2) of the Bhartiya Nagarik Suraksha Sanhita permit the grant of anticipatory bail in this case
