Holding

The court denied bail to the petitioner.

Summary

Saroj Singh was arrested on 7 June 2025 in connection with FIR No. 113 of 2025 alleging possession of an AK‑47, magazines, cartridges, land documents and Panchayat stamps. The prosecution charged him under Sections 132, 109, 186, 317(5), 3(5) of the Bharatiya Nyay Sanhita, 2023 and Sections 25(1‑A), 25(1‑B)(a), 26, 27 and 35 of the Arms Act. The petitioner claimed innocence, alleging that the FIR was fabricated and that the investigation violated Sections 103 and 105 of the BNSS and Rules 165(d)(e)(f) of the Bihar Police Manual. The State highlighted the recovery of the weapons and the petitioner’s twelve prior criminal antecedents and opposed bail. The High Court, after considering the seriousness of the offences, the evidence recovered and the procedural claims, declined to grant bail, refusing the petition.

Issues considered

  • Whether bail should be granted in a case involving alleged possession of illegal firearms and related offences.
  • Whether alleged non‑compliance with Sections 103 and 105 of the Bharatiya Nyay Sanhita and Rules 165(d)(e)(f) of the Bihar Police Manual warrants bail.
  • Impact of the petitioner’s prior criminal antecedents on the grant of bail.
