Patna High Court

Aditya Kumar @ BadalversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court allowed the application for regular bail, directing the petitioner’s release on bond.

Summary

The petitioner, Aditya Kumar, was charged under Sections 341, 323, 325, 307, 379, 504, 506 and 34 of the Indian Penal Code for assaulting an informant with a pistol, causing grievous injury. He applied for regular bail, claiming innocence and citing a clean antecedent, having been in custody since 22 August 2025. The State opposed the bail application. The Court considered the nature of the offences, the petitioner’s clean record, and the period of custody, and concluded that bail was appropriate. Accordingly, the Court ordered his release on bail with a bond of Rs.10,000 and two sureties of the same amount. The judgment expressly noted that its observations were prima facie and not a determination on the merits of the case.

Issues considered

  • Whether the petitioner is entitled to regular bail despite the seriousness of the offences under the IPC
  • Whether the petitioner’s clean antecedent and period of custody justify the grant of bail
