The court held that regular bail could not be granted to the petitioner.

Summary

Shambhu Mahto was arrested in connection with a robbery in which he allegedly snatched cash, a gold ornament, and several personal documents from an informant. He is charged under Sections 303(2) and 304(2) of the Bharatiya Nyaya Sanhita, 2023. The petitioner, who has been in custody since 2 July 2025, also has four prior serious criminal antecedents. The court examined the seriousness of the allegations, the material linking the petitioner to the crime, and his criminal record. Considering these factors, the court declined to grant regular bail, stating that the observations were prima facie and limited to the bail application. The bail application was therefore rejected.
