BAIL GRANTED

Holding

The court granted regular bail to the petitioner subject to bond and surety conditions.

Summary

Ashok Das was arrested in connection with a case registered under multiple sections of the Bihar Penal Code for alleged assaults involving a sword and other weapons. He claimed innocence, alleging that the charges stemmed from a family dispute related to a marriage between his nephew and the informant's daughter, who had previously lodged a complaint. The State opposed his bail application. The court examined the facts and circumstances, noting the petitioner’s claim of false implication and his custody since November 2025. It ordered his release on regular bail upon furnishing a bond of Rs.10,000 with two sureties of the same amount, subject to his cooperation in the trial. The bail was granted with conditions to appear as required.

as learned APP for the State.

                                   2. In this case, the petitioner is seeking regular bail

in connection with Jalley P.S. Case No. 219 of 2025, registered

for the offences punishable under Sections 191(2), 190(2),

                   126(2), 127(2), 115(2), 118(1), 117(2), 109(1), 352, 351(2) of

                   the BNS.

                                   3. The prosecution alleges that the petitioner

assaulted Jai Kishore Das on his head with sword, while co-

accused Nagendra Das assaulted Ajay Das, and Babloo Das is

accused of assaulting Govind Das on his head with farsa.

                                  4. The learned counsel for the petitioner has

submitted that the petitioner is innocent and has falsely been

implicated. As a matter of fact, the nephew of the petitioner has

solemnized marriage with daughter of the informant for which

she has lodged Jalley P.S. Case No. 120 of 2025. In that case

also, she implicated all the family members. The present case

has been lodged due to previous animosity. The petitioner has

falsely been implicated merely because he is uncle of Ravi

Kumar with whom daughter of the informant has solemnized

marriage. The petitioner is under custody since 15.11.2025.

                                   5. On the other hand, the learned APP for the State

has opposed the prayer for bail.

                                    6. Considering the above-mentioned facts and

circumstances, let the petitioner above-named be released on

bail on furnishing bail bonds of Rs.10,000/- with two sureties

of the like amount each to the satisfaction of learned A.C.J.M.-I,

Darbhanga in connection with Jalley P.S. Case No. 219 of 2025,

subject to the condition that the petitioner shall cooperate in the

disposal of trial and make himself available as and when

                     required by the court.
