Holding

The application for regular bail is dismissed as there are no new grounds to review the earlier order.

Summary

The petitioner, Braj Bihari Jha, was charged with murder under Section 302 of the Indian Penal Code and an offence under Section 27 of the Arms Act, and has been in custody since June 28, 2024. He filed a second application for regular bail after an earlier bail request was rejected on the ground of the seriousness of the offence and his criminal antecedents. The court noted that the charge had already been framed and the trial was progressing, finding no new ground to revisit its earlier decision. Considering the gravity of the charges and the lack of any change in circumstances, the court dismissed the bail application. The court also directed the Superintendent of Police, Madhubani, to ensure the attendance of witnesses in the ongoing trial.

Issues considered

  • Whether the petitioner is entitled to regular bail at this stage of the trial
  • Whether any new ground exists to review the earlier bail denial
  • Whether trial delay by the prosecution justifies granting bail
