Decided
Disposal
BAIL GRANTED

Holding

Anticipatory bail was granted to the petitioner subject to conditions under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.

Summary

The petitioner, Rabindra Kumar Mahto, was charged under IPC sections 420, 467, 468, 471 and 120B for allegedly obtaining a Panchayat Teacher appointment using forged certificates. He had previously applied for pre‑arrest bail, which was denied on 30‑07‑2024. The petitioner contended that he had resigned from the post on 12‑12‑2023, possessed a clean antecedent, and was innocent of the alleged offences. The State opposed the bail application. Considering the resignation, clean antecedent and the nature of the allegations, the Court granted anticipatory bail, directing that if arrested within eight weeks the petitioner be released on a bail bond of Rs.10,000 with two sureties, subject to conditions under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner despite serious charges under the IPC
  • Whether the resignation and clean antecedent justify the grant of bail
  • Applicability of Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023 in granting anticipatory bail
