Holding
Anticipatory bail was granted to the petitioners subject to conditions under Section 482 of the B.N.S.S.
Summary
The petitioners, Navnit Yadav and co‑accused, sought anticipatory bail fearing arrest in a case registered under Sections 126(2), 115(2), 109(1) and 3(5) of the Bhartiya Nyaya Sanhita for allegedly assaulting the younger brothers of an informant. The FIR recorded simple injuries and the petitioners asserted a clean antecedent. The State opposed the bail on the ground of the offences alleged. The Court examined the nature of the injuries, the clean record of the petitioners and the statutory provisions, and held that anticipatory bail could be granted subject to conditions. Accordingly, each petitioner was ordered to furnish a bail bond of Rs 10,000 with two sureties and to surrender within eight weeks, under the power of Section 482 of the B.N.S.S.
Issues considered
- Whether anticipatory bail should be granted to the petitioners despite the offences alleged under the Bhartiya Nyaya Sanhita.
- Whether the nature of injury and the petitioners' clean antecedent justify the grant of bail.
