Holding
Anticipatory bail was denied to the petitioner.
Summary
The petitioner, Kanchan Yadav, sought anticipatory bail fearing arrest in a case registered under multiple sections of the Bihar Narcotic Substances Act, 2023. The FIR alleges that the petitioner, along with 20-25 unknown persons, intercepted a tractor seized by police, seized a police vehicle, and forcibly released detained tractor drivers. The petitioner also has two prior criminal antecedents. The learned counsel argued that the nature of the allegations and the antecedents warranted bail, while the State opposed the relief. The Court examined the seriousness of the offences and the petitioner’s criminal record and concluded that granting anticipatory bail would be inappropriate. Consequently, the petition for anticipatory bail was rejected.
Issues considered
- Whether anticipatory bail should be granted to the petitioner given the nature of the offences under the Bihar Narcotic Substances Act, 2023 and his prior criminal antecedents.
