BAIL REJECTED

Holding

The Court denied bail, holding that the seriousness of the charges and the evidence of grievous injury justified the petitioners' continued detention.

Summary

Motim Khan and Jugnu Khan petitioned the Patna High Court seeking bail after being implicated in a case under sections 126(2), 115(2), 118(2), 109(1), 303(2) and 3(5) of the Bharatiya Nyaya Sanhita, 2023, alleging they stabbed the husband of an informant, causing grievous injuries. The prosecution presented the allegation of a stabbing, while the petitioners claimed they were falsely implicated due to a land dispute and asserted a clean antecedent. The State opposed the bail application, emphasizing the seriousness of the offences. After hearing both sides, the Court considered the gravity of the accusations and the nature of the alleged crime. The Court rejected the petitioners' bail plea, concluding that the seriousness of the charges warranted continued custody.
