The court granted bail to the petitioners subject to a bond of Rs.10,000 each with two sureties, under section 482(2) of the Bharatiya Nagarik Suraksha Sanhita.
Summary
The petitioners, three brothers from Vaishali district, were arrested in a case registered under multiple sections of the Bharatiya Nagarik Suraksha Sanhita for allegedly assaulting an informant and others during a land dispute. They contended that the incident was a simple altercation arising from a long-standing land conflict and that the charges were general and omnibus. The State opposed the bail application. The court considered the nature of the allegations, the pending civil litigations, and the seriousness of the offences. It ordered that the petitioners be released on bail upon furnishing a bond of Rs.10,000 each with two sureties, subject to conditions under section 482(2) of the BNSS. The bail order was directed to be complied with by the Chief Judicial Magistrate, Vaishali.
Issues considered
- Whether the petitioners are entitled to bail despite the serious offences alleged under sections 126(2), 115(2), 118(1), 109, 76, 352, 351(2) and 3(5) of the Bharatiya Nagarik Suraksha Sanhita
- Whether the general and omnibus nature of the allegations and the underlying land dispute justify denial of bail
