Bail was denied to petitioner No.1 but granted to petitioners Nos.2 and 3 subject to bond and conditions under Section 482(2) of the BNSS.
Summary
The petitioners Angad Ranjan, Dinesh Das and Ravindra Das sought pre‑arrest bail in a case registered under several sections of the Bharatiya Nagarik Suraksha Sanhita (BNSS) for alleged assault, outraging the modesty of the informant's sister‑in‑law and theft of Rs.50,000. The FIR alleged that all three accused participated in the assault, but the petitioners argued that the allegations against them were general and omnibus with no specific overt act. The State contended that there was a specific allegation against petitioner No.1 for outraging modesty. The Court rejected the bail application of petitioner No.1, deeming the accusation serious and the offence grave. However, it granted bail to petitioners Nos.2 and 3, subject to a bond of Rs.10,000 each, two sureties, and conditions under Section 482(2) of the BNSS, provided they surrender within eight weeks.
Issues considered
- Whether the seriousness of the allegation of outraging modesty justifies denial of pre‑arrest bail to petitioner No.1.
- Whether general and omnibus allegations against petitioners Nos.2 and 3 are sufficient to deny bail.
- Whether Section 482(2) of the BNSS applies to the grant of bail in this case.
