Decided

BAIL REJECTED

Holding

Pre‑arrest bail was denied.

Summary

Lorik Yadav applied for pre‑arrest bail after learning that he was likely to be arrested in a case under Section 414 of the Indian Penal Code. The prosecution alleged that two stolen cars, seized by an informant, were used by the accused to transport illegal liquor, and that Yadav's name surfaced during the investigation. The court noted that Yadav has six prior criminal records, three of which are of a similar nature. Considering the seriousness of the alleged offence, the nature of the accusations, and the petitioner’s criminal antecedents, the court found no sufficient ground to grant bail. Consequently, the petition for pre‑arrest bail was rejected.

Issues considered

  • Whether pre‑arrest bail should be granted to the petitioner in a case under Section 414 IPC given the nature of the allegations and his criminal antecedents.
