Patna High Court

Arun SinghversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted bail to the petitioner, finding no sufficient ground to deny release.

Summary

Arun Singh was arrested in connection with a violent incident in which co‑accused fired at an informant’s father, causing his death, and others assaulted family members. He is charged under several sections of the Bihar Narcotic Substances Act, 2023 and the Arms Act for allegedly firing at a person named Shambhu Kumar, though the injury report shows no firearm injury. The petitioner, in custody since 6 June 2025, applied for bail, contending he was not the shooter of the deceased and that the evidence against him is weak. The State opposed the bail on the seriousness of the offences. The High Court, after considering the facts and the length of custody, allowed the bail application, directing the petitioner to furnish a bail bond of Rs. 10,000 with two sureties.

Issues considered

  • Whether bail can be granted to an accused charged with multiple serious offences, including offences under the Arms Act and the Bihar Narcotic Substances Act, when co‑accused have committed homicide.
  • Whether the absence of firearm injury to the alleged victim (Shambhu Kumar) negates the charge against the petitioner.
  • Whether the period of custody (since 6 June 2025) warrants the grant of bail.

learned A.P.P. for the State .

                                2. The petitioner seeks bail in a case registered for the

                   offences punishable under Sections 191(2), 191(3), 190, 115(2),

                      upon one Shambhu Kumar.

                                   4. Learned counsel for the petitioner submits that the

petitioner is not the assailant of the deceased. He is alleged only

to have fired upon one Shambhu Kumar but as per injury report

of Shambhu Kumar, no firearms injury was found. Petitioner is

in custody since 06.06.2025 and the charge-sheet has been

the prayer for grant of bail.

custody , the prayer for grant of bail to the petitioner is allowed.

                                    7. Accordingly, let the above-named petitioner be

released on bail on furnishing a bail bond of Rs. 10,000/- (ten

thousand) with two sureties of the like amount each to the
