Holding
The Court granted pre‑arrest bail to the petitioner subject to a bail bond and sureties under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
Summary
Manish Yadav was implicated in a case (Rajoun P.S. Case No. 389 of 2023) alleging assault on police officers and damage to a police vehicle, invoking multiple sections of the Indian Penal Code. He applied for pre‑arrest bail, contending that he was falsely implicated, that no specific role was assigned to him, and that a co‑accused had already been granted anticipatory bail in a similar matter. The State opposed the bail, highlighting Yadav’s four prior criminal cases. The Court examined the nature of the allegations, the petitioner’s claim of false implication, and the precedent of anticipatory bail. It held that the petitioner could be released on pre‑arrest bail, subject to a bond of Rs. 10,000 and two sureties, under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. The order directed the petitioner to surrender within four weeks if arrested.
Issues considered
- Whether the petitioner is entitled to pre‑arrest bail under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023 despite the serious nature of the offences alleged.
- Whether the petitioner’s claim of false implication and lack of specific role warrants bail.
- Whether the petitioner’s prior criminal antecedents preclude the grant of bail.
- Whether the anticipatory bail granted to a co‑accused is persuasive in this case.
