DISMISSED

Holding

Anticipatory bail was not granted to the petitioner.

Summary

Kari Singh, also known as Prince Kumar Singh, was arrested in connection with Rosera P.S. Case No. 314 of 2025 for offences under Sections 308(4), 109 and 3(5) of the B.N.S. read with Section 27 of the Arms Act. The prosecution alleges that he demanded extortion from an informant and opened fire, injuring a labourer. The petitioner pleaded innocence and sought anticipatory bail, while the State highlighted that he is already implicated in six other serious cases. The court examined the nature and gravity of the alleged offences and the petitioner’s criminal antecedents. Concluding that the seriousness and prior record outweighed the bail considerations, the court refused to grant anticipatory bail and dismissed the application.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner given the seriousness of the offences under the B.N.S. and Arms Act.
  • Whether the petitioner’s prior criminal antecedents justify denial of bail.
