The application for regular bail was dismissed as no new ground existed to overturn the earlier denial.
Summary
Sharwan Yadav, alleged hardcore Naxal, was arrested on 23 July 2022 and charged under multiple sections of the Indian Penal Code, the Arms Act and the Unlawful Activities (Prevention) Act, including possession of an AK‑56, cartridges and cash. This was his third application for regular bail in the Sessions case arising from Bhadwar police station, after earlier bail pleas were rejected in September 2023 and September 2024. The petitioner argued that the charge had already been framed and the trial was progressing, seeking relief on that basis. The High Court, noting the gravity of the offences, the petitioner’s status as a hardcore Naxal and the lack of any new ground to revisit the earlier orders, dismissed the bail application. The court also directed the Senior Superintendent of Police, Gaya, to ensure attendance of witnesses in the ongoing trial.
Issues considered
- Whether the petitioner is entitled to regular bail despite being charged with serious offences under the IPC, Arms Act and UAPA and being designated a hardcore Naxal
- Whether there exists any fresh ground to review the earlier orders denying bail
