Decided
Disposal
DISMISSED

Holding

The Court held that, given the seriousness of the alleged offence and the petitioner’s identification in the T.I. parade, bail could not be granted.

Summary

The petitioner, Rabin Yadav, applied for regular bail in a case registered as Udakishunganj P.S. Case No. 279/2025, which alleged offences under Section 309(4) of the B.N.S. The prosecution alleged that unknown criminals looted Rs. 4,13,500 and a motorcycle belonging to an informant, and the petitioner was identified in the T.I. parade. The petitioner’s counsel argued that he was falsely implicated, has five prior criminal antecedents for which he is already on bail, and has been in custody since 18‑08‑2025, undertaking to cooperate with the trial. The Additional Public Prosecutor opposed bail, emphasizing the petitioner’s identification and the seriousness of the offence. The Court, after considering the gravity of the alleged crime and the identification, declined to grant bail and dismissed the application.

Issues considered

  • Whether bail should be granted to the petitioner in a case involving alleged looting and theft under Section 309(4) of the B.N.S.
