Holding

The court allowed the modification, granting an additional four‑week extension for surrender and bail bond furnishing.

Summary

The petitioner, Balli Sah, filed an application seeking modification of a prior order dated 23-10-2024 which had granted a four‑week extension to surrender and furnish bail bonds. The application was filed after a considerable delay. The court, after hearing submissions from both counsel, considered whether the delay justified denial of the modification. It held that despite the delay, the petitioner's arguments warranted relief. Consequently, the court extended the surrender period by an additional four weeks and imposed a cost of Rs.5,000 to be deposited with the Legal Services Committee. The order dated 23-10-2024 was thereby modified accordingly.

Issues considered

  • Whether the application for modification of the earlier order granting time to surrender and furnish bail bonds should be allowed despite the delay in filing.
