The court granted bail to the petitioner.

Summary

Raja Kumar was arrested in connection with NDPS Case No. 74 of 2025 for alleged possession of 50 grams of smack, alleged violations of Sections 8(C) and 21(b) of the NDPS Act and Section 111 of the Bihar Narcotic Substances Act, 2023. The petitioner claimed innocence, argued that the seizure was not made in compliance with Section 105 of the BNSS Act, and contended that the quantity seized was far below commercial levels. The State opposed bail, citing two prior criminal cases against the petitioner. After hearing both sides, the Patna High Court found that the circumstances warranted bail despite the alleged quantity and prior antecedents. The court ordered the petitioner to be released on bail upon furnishing a bond of Rs. 10,000 with two sureties, subject to the satisfaction of the concerned Special Judge.

Issues considered

  • Whether bail can be granted in an NDNDPS case involving possession of 50 grams of contraband.
  • Whether non‑compliance with Section 105 of the BNSS Act during seizure vitiates the prosecution’s case.
  • Whether the petitioner’s prior criminal antecedents preclude bail.

the petitioner and Mr. Ajit Kumar, learned APP for the State.

                                 2. The petitioner has prayed for bail in connection with

N.D.P.S. Case No. 74 of 2025 arising out of Sahebpur Kamal P.S.

Case No. 296 of 2025 registered for the offence punishable under

                                 3. The case of the prosecution in short is that altogether

                   petitioner.

                                 4. Learned counsel appearing on behalf of the petitioner

has submitted that petitioner is innocent and has committed no

this petitioner. He also submits the witnesses of the seizure list are

police personnel and the police has not complied with Section 105

but is much less than commercial quantity. Moreover, the

petitioner is languishing in judicial custody since 10.10.2025.

                                  5. The application for bail is opposed by learned APP

for the State and submits that the petitioner is having criminal

                     antecedent of two cases.

considering the facts and circumstances of the case, this Court is

inclined to enlarge the petitioner on bail. The above named

petitioner is directed to be enlarged on bail on furnishing bail bond

of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the
