The court granted regular bail to the petitioners upon furnishing a bail bond of Rs.10,000 each with two sureties.
Summary
Petitioners Sajda Khanam and Jayaur Rahman, who are Chairman and Manager of a PACS, applied for regular bail in a case alleging defalcation of Rs.19,63,462 under sections 316(2), 316(5), 318(4) and 3(5) of the Bihar Negotiable Instruments Act. The prosecution contended that the amount was misappropriated, while the petitioners claimed innocence, cited lack of criminal antecedent, and offered to deposit the entire amount within a year. They have been in judicial custody since early December 2025. The State opposed bail, but the court, after considering the facts, the petitioners' willingness to pay, and their clean record, ordered their release on regular bail. Each petitioner was required to furnish a bail bond of Rs.10,000 with two sureties of the same amount.
Issues considered
- Whether the petitioners are entitled to regular bail despite alleged defalcation under the Bihar Negotiable Instruments Act.
- Whether the petitioners' willingness to deposit the full amount within a year justifies granting bail.
- Whether the absence of prior criminal antecedent and the period of custodial detention affect the bail decision.
