Patna High Court

Prince Kumar @ RamdevversusThe State of Bihar

Decided
Disposal
REJECTED

Holding

The court denied bail, holding that the recorded confessional statement and the seriousness of the charges justify refusal of the petition.

Summary

Prince Kumar, also known as Ramdev, was arrested on 28 July 2025 in connection with a murder allegedly committed by firing a weapon at the brother of an informant. The petitioner sought bail, arguing that the informant was not an eye‑witness and that the investigation had produced no material linking him to the crime. The State opposed bail, relying on a confessional statement recorded in the case diary in which the petitioner admitted to the offence and on the recovery of the weapon used. The court examined the seriousness of the charges under Sections 103(1) and 3(5) of the Bihar Narcotic Substances Act, 2023, and Section 27 of the Arms Act, and considered the existence of a direct confession. Finding the confession credible and the allegations specific, the court concluded that bail could not be granted. Consequently, the petition for bail was refused.

Issues considered

  • Whether the petitioner is entitled to bail despite a recorded confessional statement.
  • Whether the confession recorded in the case diary is admissible and sufficient to deny bail.
  • Whether the seriousness of the offences under the B.N.S., 2023 and the Arms Act warrants denial of bail.
