Patna High Court

Md Sarwar AliversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court held that bail should be granted as the prosecution’s case rests solely on a confessional statement of a co‑accused and lacks any other material evidence.

Summary

The petitioner, Md Sarwar Ali, sought bail in a case registered under Sections 103(1), 61(2), 238 and 3(5) of the Bharatiya Nagarik Suraksha Sanhita, 2023, relating to the death of a person allegedly found after leaving with Md Madroof. The prosecution’s case relied solely on a confessional statement of co‑accused Md Madrul, who had already been granted bail, and there were no eye‑witnesses or other material linking the petitioner to the offence. The petitioner’s counsel argued that he was not named in the FIR and that the accusation was based only on suspicion, emphasizing his clean antecedents. The State opposed the bail application. Considering the lack of substantive evidence beyond the co‑accused’s confession, the court ordered the petitioner’s release on bail with a bond of Rs.10,000 and two sureties, subject to Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.

Issues considered

  • Whether bail can be granted when the only evidence against the petitioner is a confessional statement of a co‑accused
  • Whether the petitioner’s apprehension of arrest is justified in the absence of direct evidence
  • Applicability of Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023 for granting bail
