The bail bond shall be accepted only if the petitioner is not involved in any case other than Naubatpur P.S. Case No. 797 of 2024 and Piplawan P.S. Case No. 117 of 2024.

Summary

The petitioner, Randhir Kumar, had been granted regular bail on 12 January 2026 with a condition that his criminal antecedent be verified before accepting the bail bond. The bail order required that if he was involved in any case other than those listed in paragraph‑3 of his bail application, the bond would be rejected. The petitioner argued that he had omitted mentioning a case (Piplawan P.S. Case No. 117 of 2024 under Section 309(4) of the BNS) due to lack of knowledge. The court allowed a modification of the bail order, limiting the verification to only two specific cases – Naubatpur P.S. Case No. 797 of 2024 and Piplawan P.S. Case No. 117 of 2024 – and extended the surrender period by four weeks. All other terms and conditions of the original bail order remained unchanged.

Issues considered

  • Whether the bail bond can be accepted when the petitioner has undisclosed pending criminal cases.
  • Scope of modification of bail conditions to include verification of criminal antecedent limited to specified cases.
