Vikash KumarversusThe State of Bihar

Decided
Disposal
DISMISSED

Holding

The Court held that bail could not be granted due to the seriousness of the offences, especially the alleged rape of a minor.

Summary

Vikash Kumar was arrested in connection with a case registered under Sections 341, 342, 366(A), 376 and 34 of the Indian Penal Code and Section 6 of the POCSO Act, alleging that he raped a minor after confining her. The petitioner applied for regular bail, claiming false implication, no prior criminal record and willingness to cooperate with the trial. The State opposed the bail on the ground of the seriousness of the alleged rape of a minor. The Court examined the gravity of the offences, particularly the POCSO charge, and concluded that bail could not be granted. Consequently, the bail application was dismissed.
