The court held that the criminal miscellaneous proceeding may be restored, subject to the petitioner depositing Rs.10,000.
Summary
The petitioner, Sandeep Kumar, filed an application seeking restoration of Criminal Miscellaneous No. 2589 of 2021, which had been dismissed on 28 June 2022 for non‑prosecution. The High Court examined the reasons furnished by the petitioner for the lapse. Finding merit in the petitioner's explanation, the Court allowed the restoration but imposed a condition that the petitioner deposit Rs.10,000 with the Patna High Court Legal Services Committee. The order directed that the case be restored to its original file and the office verify compliance. Thus, the criminal proceeding was revived subject to the stipulated deposit.
