Patna High Court

Md. Ismail @ IsailversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Bail was granted to the petitioner subject to conditions under Section 480(3) of the BNSS.

Summary

The petitioner, Md. Ismail, was arrested with a stolen motorcycle after police acted on a tip. He claims he bought the motorcycle in good faith from a co‑accused and is innocent, citing a clean antecedent and that the charge sheet has been filed. The State opposed bail, arguing the seriousness of the offence under Section 317(5) of the BNS, 2023. The court considered the petitioner’s custody duration, clean record, and the charge sheet, and applied the provisions of Section 480(3) of the BNSS. Accordingly, the court granted bail on a Rs.10,000 bond with two sureties and imposed conditions regarding attendance and surety qualifications. The bail order was directed to be executed by the Judicial Magistrate‑1st Class, Katihar.

Issues considered

  • Whether bail should be granted to the accused under Section 317(5) of the BNS, 2023 considering the facts of the case
  • Whether the petitioner’s clean antecedent and the filing of the charge sheet justify bail
