DISMISSED

Holding

The court held that regular bail could not be granted and dismissed the petitioner's bail application.

Summary

The petitioner, Ravi Kumar, was charged under Sections 25(1‑b)a and 35 of the Arms Act for possession of a firearm and 40.50 g of brown sugar, recovered from his residence. He has been in custody since 21 July 2024 and has six prior criminal convictions. The petitioner applied for regular bail, arguing that the trial was progressing with only one of four witnesses examined. The court noted the seriousness of the offences, the petitioner’s extensive criminal history, and the incomplete trial, finding no sufficient ground to grant bail. Consequently, the court dismissed the bail application, upholding its earlier order denying bail.

Issues considered

  • Whether regular bail should be granted to an accused charged under Sections 25(1‑b)a and 35 of the Arms Act with a serious offence and multiple prior convictions
  • Whether the earlier denial of bail can be reviewed in light of the trial’s progress

                                              2. This application is for grant of regular bail
in connection with Dhamdaha P.S. Case No.141

Patna High Court CR. MISC. No.9828 of 2026(2) dt.16-02-2026
                                                          2/2

                                                    5. Considering the criminal history of
the petitioner, I am not inclined to extend the privilege of
                                        regular bail to the petitioner.
                                                    6. Accordingly, this application is dismissed.

                                     3. It has been submitted by the learned counsel for the

petitioner that the trial is progressing and only one out of four

witnesses have been examined. Petitioner has six criminal

                        antecedents.

                                     4. Considering the gravity of the offence and criminal

antecedents of the petitioner, this Court finds no ground to

                        review its earlier order.

                                     5. Accordingly, this application is dismissed again.
