Patna High Court

Hridyanand Singh @ BhuarversusThe State of Bihar

Decided
Disposal
BAIL REJECTED

Holding

Anticipatory bail was denied as the petitioner was found to be the person who inflicted the knife injury.

Summary

The petitioner, Hridyanand Singh, sought anticipatory bail after being implicated in a case (Sanjhauli P.S. Case No. 145 of 2025) for alleged offences under Sections 126(2), 109(1), 352, 351(2) and 3(5) of the B.N.S. The prosecution alleged that the petitioner stabbed the informant’s son with a knife, causing serious injury. The petitioner’s counsel argued his innocence, but the State relied on the FIR which directly implicated him in the assault. The court examined the FIR and found sufficient material to conclude that the petitioner was indeed the assailant. Consequently, the court held that no grounds existed to grant anticipatory bail. The anticipatory bail application was therefore rejected.

Issues considered

  • Whether the petitioner is entitled to anticipatory bail in view of the allegations under Sections 126(2), 109(1), 352, 351(2) and 3(5) of the B.N.S.

2 23-02-2026 Heard Mr. Raghunandan Kumar Singh, learned

counsel for the petitioner and learned APP representing the

                   State.

                                 2. The petitioner is apprehending his arrest in

connection with Sanjhauli P.S. Case No. 145 of 2025 registered

for the offence punishable under Sections 126(2), 109(1), 352,

351(2) and 3(5) of the B.N.S., lodged on 27.07.2025 by the

                   informant Meena Devi.

                                 3. As per the prosecution story, the informant alleged

that while she was sitting at her door, the accused persons came

armed variously and after Bhorik Singh caught hold hand of her

son, the present petitioner gave knife blow on the chest causing

severe injury. He was taken to Karuna Hospital, Bikramganj

                   which followed the F.I.R..

                                   4. Though learned counsel for the petitioner tried to

impress upon this Court regarding the innocence of the

petitioner, learned APP has taken this Court to the F.I.R. to show

that it is the petitioner who gave knife blow on the chest of the

informant’s son. In that background, no relief can be extended to

                      the petitioner.

                                   5. The anticipatory bail application stands rejected.
