Reema KumariversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court held that, given the non‑specific allegations and the petitioners' clean antecedent, bail should be granted subject to the conditions prescribed under Section 482(2) of the B.N.S.S.

Summary

The petitioners, three unmarried women aged 20‑22, applied for bail after being implicated in a case (PS No. 514 of 2025) alleging assault on the informant's family under several sections of the B.N.S. The prosecution alleged that the petitioners assaulted the informant's mother with an iron rod, causing a fracture. The petitioners contended they were falsely implicated, highlighting the non‑specific nature of the allegations and their clean antecedents. The informant’s counsel presented a medical report indicating grievous injuries. After considering the submissions and the vague nature of the charges, the court ordered that the petitioners be released on bail with a bond of Rs.10,000 each, two sureties, and conditions under Section 482(2) of the B.N.S.S., including personal appearance in court.

Issues considered

  • Whether the petitioners are entitled to bail despite the serious charges under Sections 126(2), 115(2), 118(1), 109, 303(2), 117(2) and 3(5) of the B.N.S.
  • Whether the non‑specific nature of the allegations and the petitioners' clean antecedent justify granting bail under Section 482(2) of the B.N.S.S.
