Pappu RamversusThe State of Bihar

Decided
Disposal
DISMISSED

Holding

The court dismissed the petitioner's application for regular bail, refusing to grant it.

Summary

The petitioner, Pappu Ram, was charged under multiple sections of the Indian Penal Code, including murder (302) and other offences, for allegedly assaulting a deceased person, causing a fatal head injury. He has been in custody since 25 April 2024 and filed a second application for regular bail after an earlier denial. The State opposed the bail, emphasizing the seriousness of the charges. The court noted the gravity of the offences and the lack of compelling reasons to overturn its prior order, despite the petitioner's claim of a clean antecedent and partial witness testimony. Consequently, the court dismissed the bail application, refusing to grant regular bail.

Issues considered

  • Whether regular bail should be granted to an accused of murder and related offences under the Indian Penal Code.
  • Whether the court should revisit its earlier order denying bail in light of the petitioner's arguments.

                                                    4. Learned APP appearing for the State
opposes the prayer for regular bail of the petitioner.
                                                    5. Considering the allegation levelled against
the petitioner, this Court is not inclined to grant bail to

                                        dismissed.

                                     3. It has been submitted by the learned counsel for the

                                     4. Considering the gravity of offence, this Court finds

no ground to review its earlier order.

                                     5. Accordingly, this application is dismissed again.
