Patna High Court

Pappu YadavversusThe State of Bihar

Decided
Disposal
BAIL REJECTED

Holding

Bail was denied to the petitioner.

Summary

The petitioner, Pappu Yadav, was charged with multiple offences including assault with a knife that caused the death of an informant's father‑in‑law. The prosecution alleged that the petitioner, along with others, entered the informant’s house, abused her, and, upon protest by her father‑in‑law, assaulted him with a knife, resulting in his immediate death. The petitioner claimed innocence, arguing he was falsely implicated due to a long‑standing land dispute and has been in custody since September 2024. The State opposed bail, emphasizing the specific accusation, the gravity of the offences, and the petitioner’s prior criminal antecedent. The court, considering the seriousness of the charges and the petitioner’s antecedent, rejected the bail application and directed the trial court to expedite the trial within one year.

                                       ORAL ORDER

2 18-02-2026 Heard learned counsel for the petitioner and learned

                   A.P.P. for the State.

                                2. The petitioner seeks bail in a case registered for the

                   offence punishable under Sections 191(2), 191(3), 190, 126(2),

                   115(2), 118(1), 109, 103, 352 and 351(2) of the B.N.S..

                                3. As per the prosecution case, it is alleged that all the

FIR named accused persons, including this petitioner, came to

the house of the informant and started abusing her and on

protest by her father-in-law, all the accused persons assaulted

him. It is specifically alleged that this petitioner indiscriminately

assaulted the informant as well as her father-in-law by means of

knife due to which father-in-law of the informant died on the

          spot.

                       4. Learned counsel for the petitioner submits that

petitioner is quite innocent and has committed no offence.

Petitioner has falsely been implicated in this case due to long

standing land dispute between the parties. Moreover, charge-

sheet has already been submitted and petitioner is in custody

          since 18.09.2024.

                       5. On the other hand, learned A.P.P. for the State has

vehemently opposed the prayer for grant of bail to the petitioner

and submitted that petitioner is named in the F.I.R. with specific

accusation that he assaulted informant and her father-in-law

with knife as a result of which, father-in-law of informant died.

Petitioner appears to be assailant of the deceased and has got

          one criminal antecedent.

                       6. Considering the facts and circumstances of the

case, specific and direct nature of accusation, gravity of offence

and criminal antecedent of the petitioner, the prayer for grant

bail of to the petitioner is rejected.

                       7. However, considering the fact that petitioner is in

custody since 18.09.2024, the learned trial court is directed to

expedite the trial and conclude the same, preferably within a
