Patna High Court

Jagdish PaswanversusThe State of Bihar

Decided
Disposal
DISMISS FOR NON-PROSECUTION

Holding

The petition is dismissed and the earlier order granting relief is vacated due to the petitioner’s failure to comply and non‑appearance.

Summary

Jagdish Paswan filed a criminal revision seeking relief from coercive steps in a 2018 complaint case, having earlier obtained an order on 25‑Nov‑2025 that allowed him to avoid such steps provided he paid Rs 17 lakh in installments, with the first Rs 6 lakh due by 24‑Dec‑2025. He failed to make the payment and did not appear before the court when the matter was listed again on 20‑Jan‑2026. The respondent’s counsel highlighted this non‑compliance and warned that further orders would be issued if the petitioner continued to ignore the court’s direction. Since the petitioner neither complied with the earlier order nor appeared, the court dismissed the revision petition for non‑prosecution and vacated the earlier relief, directing the trial court to take appropriate action.

Issues considered

  • Whether a criminal revision petition can be dismissed for non‑prosecution when the petitioner fails to comply with a court‑ordered compensation scheme and makes no appearance.

Subjects

  • criminal revision
  • non‑prosecution

opposite party no.2 submits that the petitioner failed to comply

the order dated 25.11.2025 passed by this Court. The learned

counsel further submits that the order was passed on prayer of

the petitioner that he was ready to make payment of

compensation amount of Rs. 17 lacs within a year in twelve

the petitioner did not comply the orders and did not honour his

undertaking made before this Court. The learned counsel further

Court made it clear that appropriate orders would be passed in

case the order dated 25.11.2025 was not complied by the

                     petitioner.

                                   3. Since the petitioner failed to comply the orders of

this Court and there is no representation on behalf of the

petitioner, the present petition stands dismissed for non-

                     prosecution.

                                   4. Consequently, the order dated 25.11.2025 granting

relief of no coercive steps against the petitioner in connection

with Complaint Case No. 3428 of 2018 (Trial No. 1069/2022)

stands vacated and the learned trial court is directed to take

appropriate action in terms of its orders.
