The petition is deemed infructuous and is dismissed.

Summary

Suraj Mahto and others filed a writ petition seeking to quash a 1971 order in a ceiling pre-emption case and to obtain mandamus directing respondents not to disturb their possession of several plots they have occupied since 1969. The petitioners argued that the order could not be executed after more than 43 years and that the land had been peacefully possessed and mutated in their favour. No counsel appeared for the petitioners, while the State counsel contended that the matter was a pre-emption issue and, owing to subsequent changes in law, had become infructuous. The court examined the lack of representation and the State's submission that the relief sought was no longer maintainable. Consequently, the court held that the petition could not proceed and dismissed it as infructuous. The order of the court was that the writ petition be disposed of as become infructuous.

Issues considered

  • Whether the 1971 ceiling pre-emption order can be executed after a lapse of more than 43 years
  • Whether the petition is maintainable in the absence of petitioner representation
  • Whether changes in pre-emption law render the petition infructuous

Subjects

  • pre-emption
  • writ of certiorari
  • mandamus
  • limitation period
  • land possession
  • infructuous petition

                                  3. At the outset, learned State counsel submits that it

is a preemption matter and with the change of law, it has

                      become infructuous.

                                  4. Accordingly, the writ petition is disposed of as

                      become infructuous.
