Decided

DISPOSED

Holding

The court disposed of all the writ petitions, following the precedent of Lal Bahadur Chaudhary v. State of Bihar, and directed the petitioners to approach the District Magistrate‑Cum‑Collector for any further relief, including compensation.

Summary

The Patna High Court heard a series of civil writ petitions filed by several landowners seeking release of their raiyati lands from the Bihar Industrial Area Development Authority (BIADA). The petitioners alleged that the lands were never lawfully acquired under Sections 4A and 9 of the BIADA Act, 1974 and were transferred to BIADA by mere notification without notice, violating the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013. The court noted that the matter was substantially similar to Lal Bahadur Chaudhary v. State of Bihar (CWJC No. 3347 of 2026) and adopted the same reasoning. It ordered that the petitioners appear before the District Magistrate‑Cum‑Collector for further proceedings and that any compensation, if due, be processed according to law. All the writ petitions were consequently disposed of.

Issues considered

  • Whether the lands were lawfully acquired by the State under the BIADA Act, 1974.
  • Whether the transfer of the lands to BIADA by notification without notice violated procedural requirements of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013.
  • Whether the respondents were authorized to transfer raiyati lands in favour of BIADA.
  • Whether the petitioners are entitled to compensation for the alleged illegal acquisition.
  • Whether the writ petitions should be dismissed or remanded for further consideration.
