Patna High Court

Rajnish KumarversusThe Managing Director, Punjab National Bank

Decided
Disposal
DISPOSED

Holding

The Court directed the petitioner to file a detailed representation and ordered the bank to consider it within four weeks, thereby disposing of the writ application.

Summary

Petitioner Rajnish Kumar filed a writ application seeking a direction that Punjab National Bank consider his representation dated 28‑02‑2024, which he claimed was left pending despite a liberty granted in an earlier writ (C.W.J.C. No.16080/2021). The Court examined whether it could compel the bank to act on the representation and the procedural requirements for such a direction. It held that the petitioner must first file a detailed representation annexing the present order. The Court then directed the bank’s Chief Manager to consider the representation within four weeks and issue a reasoned order. Accordingly, the writ application was disposed with these directions.

Issues considered

  • Whether the High Court can direct a banking institution to consider a pending representation of a petitioner.
