Decided

DISPOSED

Holding

The court held that the petitioner should first approach the Collector within eight weeks for redressal, and therefore disposed of the writ petition without ordering cancellation of the mutation or deed.

Summary

Guddu Singh filed a writ petition seeking the cancellation of a mutation and a registered deed concerning his land, alleging that the Circle Officer had illegally sold the property to other parties. He requested the court to direct the authorities to cancel the mutation, take action against the official who sold the land, and annul the deed dated 20-10-2021. The petitioner’s counsel argued that the grievance should be presented to the Collector of Vaishali for redress. The State counsel raised no objection to this approach. The High Court disposed of the petition, directing the petitioner to approach the Collector within eight weeks, after which the matter would be resolved by the concerned authorities.

Issues considered

  • Whether the petitioner is entitled to a court order cancelling the mutation and the registered deed on the basis of alleged illegal sale
  • Whether the court can direct the petitioner to approach the Collector for redressal before granting any substantive relief
