Holding

The Court held that the petitioner may approach the District Land Acquisition Officer for redressal of his compensation grievance.

Summary

The petitioner, Ram Eqbal Singh, filed a writ petition seeking a mandamus directing the State of Bihar and its officials to pay compensation of Rs. 14,40,000 for approximately 1½ katha of land acquired for the Hajipur‑Sugauli rail line. He also requested that the land be classified as Class A and that any other reliefs be granted. The petitioner’s counsel sought to be allowed to represent the District Land Acquisition Officer (DLAO) for the purpose of obtaining the compensation. The State counsel raised no objection to this request. The Court, after hearing both sides, disposed of the petition by permitting the petitioner to approach the DLAO (respondent No. 6) for redressal of his grievance, without ordering the payment of compensation or classifying the land.

Issues considered

  • Whether the State and its officials are liable to pay the claimed compensation of Rs. 14,40,000 for the acquired land.
  • Whether the petitioner’s land should be classified as Class A for compensation purposes.
  • Whether a writ of mandamus can be issued directing the respondents to make the compensation payment.

of allowing the petitioner to approach the respondent no. 6,
