The petition was dismissed as infructuous due to the lapse of time.
Summary
Petitioners Jai Prakash Gupta and Abha Rani Gupta filed writ petitions seeking to quash a public notice dated 30 September 2007 that ordered spot verification of land in Kumhrar, Patna, and to have plot No. 187 de‑notified from acquisition by the Bihar Finance Service House Construction Cooperative Society. They prayed for certiorari, mandamus, deletion of the plot from the acquisition record, and a stay of the spot verification. The State counsel argued that the petition had become infructuous because of the lapse of time since the notice and the earlier judicial orders. The Court examined the claim of lapse of time and found that the petition could no longer be entertained. Consequently, the writ petition was disposed of as infructuous, and no relief was granted.
Issues considered
- Whether the public notice for spot verification can be quashed in view of earlier judicial orders.
- Whether the petitioners are entitled to have plot No. 187 deleted and de‑notified from the land acquisition process.
- Whether the petition is barred by lapse of time and thus becomes infructuous.
