The petition was disposed of without granting the writ, with liberty granted to the petitioner to approach the appropriate authority for relief.

Summary

Madan Prasad filed a writ petition in the Patna High Court seeking a certiorari/mandamus directing the State of Bihar and land acquisition officials to pay compensation for land acquired in LA case 9 of 2010‑11, alleging that the award was not prepared under the new Land Acquisition Act, 2013 and that an illegal award for a different amount had been prepared. The petitioner’s counsel requested liberty to approach the appropriate authority for redress. The Court granted this liberty, directing the petitioner to seek relief from the competent authority, and consequently disposed of the writ petition without granting the relief sought.

Issues considered

  • Whether the High Court should issue a writ of certiorari or mandamus directing the respondents to pay compensation for the acquired land under the new Land Acquisition Act, 2013.
