The writ petition was dismissed as withdrawn with liberty to file a fresh petition.
Summary
The petitioner, Braj Bijay Singh, a government employee, filed a writ petition challenging the date of his promotion, contending that it should have been effective from 2007 rather than 2008. He argued that the promotion order dated 2008 was erroneous and sought relief to rectify the promotion date. During the hearing, the petitioner’s counsel requested permission to withdraw the present writ and file a fresh petition on the same grievance. The court considered the request and found no substantive issue requiring adjudication as the petitioner wished to restart the proceedings. Consequently, the court dismissed the writ petition as withdrawn, granting the petitioner liberty to file a fresh writ. No merits of the promotion date dispute were examined.
