Holding

The court held that the petitioner must file a fresh representation before the Secretary, Bihar Technical Service Commission, and the Commission must decide on it within 90 days, thereby disposing the writ petition.

Summary

The petitioner, Rajiv Kumar Ranjan, filed a writ petition seeking a revision of his score card in the Dresser Examination, requesting an addition of seven marks based on the Bihar Technical Service Commission's policy. He claimed that his earlier representation for redressal had not been considered. The Commission argued that it was unclear whether the representation had been received, and suggested the petitioner file a fresh representation. The court directed the petitioner to submit a new representation to the Secretary of the Bihar Technical Service Commission within 30 days, and ordered the Commission to decide on it within 90 days with a reasoned order. Consequently, the writ petition was disposed of.

Issues considered

  • Whether the petitioner is entitled to a revision of his examination score card without filing a fresh representation.
  • Whether the court can direct the petitioner to file a new representation before the Commission.
  • Whether the Commission is obligated to decide on the representation within a specified time.
