The petition is disposed with a direction to the petitioner to file a fresh petition before the Collector, who shall dispose of the matter and pass a reasoned order within three months.

Summary

Petitioner Ranjeet Kumar filed a writ petition seeking certiorari and mandamus to quash several mutation orders and to compel the disposal of an application dated 26‑12‑2024 that had been pending with the District Magistrate, Patna. The petition also challenged orders passed by the Deputy Collector, Land Reforms, Paliganj and the Anchala Adhikari, Bikram, alleging irregularities in land records. The High Court noted that the application had been received by the Collector on 26‑12‑2024 and that the appropriate forum for its disposal was the revenue authority, not the court. With the consent of both parties, the Court disposed of the writ petition, directing the petitioner to file a fresh petition before the Collector, who must hear the matter and pass a reasoned order within three months of receipt. The Court therefore declined to entertain the writ and remitted the matter to the administrative authority for resolution.

                                3. It is unfortunate that even for the disposal of an

application dated 26.12.2024 (Annexure-P/8 to the petition), the

received in the office of the respondent no. 3, the Collector, Patna

it will be taken to its logical conclusion.

                                6. With the consent of the parties, the writ petition

stands disposed of directing the petitioner to file a fresh petition

alongwith the present order before the Collector, Patna who shall

be taking up the matter and after hearing the parties, pass a

reasoned order at an earliest preferably within a period of three

months from the date the copy of the order is received in his

                    office.

                                7. The writ petition stands disposed of with the

                    aforesaid observation.
