Holding

The Court directed that the petitioner may file a fresh representation before the District Education Officer, Patna within 15 days, and that the officer must dispose of it within one month, giving a reasoned order and implementing any entitlement within 15 days of that order.

Summary

The petitioner, Sunaina Kumari, filed a writ petition seeking a mandamus directing the Bihar Education Department to allot her a school posting in Patna district following her transfer from Nalanda, citing her and her husband's critical health conditions. She argued that despite being transferred, no school had been assigned, and requested that the District Education Officer, Patna, decide on her application within a month after a hearing. The respondent State did not contest the limited relief sought. The Court, with consent of both parties, granted the petitioner liberty to file a fresh representation before the District Education Officer, Patna within 15 days. It further directed that the officer dispose of the representation within one month, issue a reasoned order, and, if the relief is warranted, implement it within 15 days of the final order. The writ application was consequently disposed of.

Issues considered
