The Court held that due to the fault in the advertisement, the BSSC must determine the petitioners' E.B.C. status and, if they have attained the cut‑off, appoint them on merit.
Summary
Fifty‑three petitioners applied for the post of Urdu Translator under Advertisement No.01/2019 of the Bihar Staff Selection Commission (BSSC). The advertisement reserved 233 posts for Extremely Backward Class (E.B.C.) candidates, but the reservation policy failed to list E.B.C. as a distinct category, leading the petitioners to mark themselves as B.C. candidates. After counseling, the BSSC clarified that a separate E.B.C. reservation existed and rejected the petitioners for having indicated B.C. status despite meeting the cut‑off marks. The petitioners argued that the omission in the advertisement caused prejudice and sought relief. The Court held that the BSSC must verify the E.B.C. status of the petitioners using the appropriate certificates and, if they satisfy the cut‑off, appoint them on merit. Consequently, the writ petition was allowed, directing the BSSC to conduct the verification and appoint eligible candidates, while noting the order is specific to these facts and not a precedent.
Issues considered
- Whether the omission of the E.B.C. category in the reservation policy of the advertisement invalidates the rejection of candidates who applied as B.C. candidates.
- Whether the Bihar Staff Selection Commission is obligated to verify the E.B.C. status of the petitioners and appoint those who meet the cut‑off marks.
- Whether allowing the petition would open a Pandora's box leading to numerous similar writs.

CORAM: HONOURABLE MR. JUSTICE BIBEK CHAUDHURI
ORAL ORDER
4 07-01-2026 There are fifty three writ petitioners, who applied for
the post of Urdu Translator on the basis of Advertisement
No.01/2019 issued by Bihar Staff Selection Commission. In all
1294 posts were to be filled up.Out of the said 1294 posts, 443
posts were reserved for women candidates of different category.
2. It is relevant to mention that out of the said 1294
posts of Urdu Translator, 233 posts were reserved for Extremely
Backward Class candidates (E.B.C.). Out of the said 233 posts,
90 posts were reserved for women candidates.
3. The learned Advocate for the petitioners refers to
the reservation policy stipulated in the above-numbered
advertisement.
4. Clause (iii) of Reservation Policy states “vkjf{kr
dksfV ¼,l0lh0@,l0Vh0@,e0ch0lh0@ch0lh0½ ds efgyk vH;FkhZ dk
tkfr@fdzfeys;j jfgr izek.k&i= muds firk ds uke ls fuxZr gksuk pkfg,^^
5. Thus, it is contended on behalf of the petitioners
that the Bihar Staff Selection Commission did not mention
E.B.C. category as Reserved Category in the reservation policy
Patna High Court CWJC No.12606 of 2025(4) dt.07-01-2026
5/7
of the advertisement. Therefore, E.B.C. Candidates filled up
their forms mentioning themselves as B.C. Candidates on the
ground that Backward Class is the genus of which Extremely
Backward Class is a species.
6. Subsequently, at the time of counseling further
notification was made in connection with Advertisement
No.01/2019 on 07.07.2022 stating, inter-alia, that:
“fiNM+k oxZ rFkk vR;Ur fiNM+k oxZ Js.kh ds vkjf{kr mEehnokjksa ds

7. Only at the time of counseling, the petitioners came
to know that there was separate reserved category for E.B.C.
Candidates.
8. However, though they were qualified acquiring cut-
off-marks, their candidature was rejected on the ground that
they described themselves as B.C. Candidates.
9. The learned Advocate on behalf of the petitioners
further refers to another Notification dated 21.01.2025, where
the Joint Secretary of Bihar Staff Selection Commission, Patna
rectified the mistake in the original advertisement, stating inter-
alia, that the M.B.C. Candidates were actually meant for E.B.C.
Candidates.
Patna High Court CWJC No.12606 of 2025(4) dt.07-01-2026
6/7
10. I have heard the learned Advocate on behalf of the
petitioners as well as the learned Advocate for the Bihar Staff
Selection Commission, Patna as well as State of Bihar.
11. It is submitted by the learned Advocate for the
Bihar Staff Selection Commission, Patna that if the writ petition
is allowed a Pandora’s box may be opened, because similarly
situated persons may come up with similar types of writs and it
will be a difficult proposition to come to a specific finding by
the Commission regarding the authenticity of the E.B.C.
Candidates.
12. The authenticity of the E.B.C. candidates can be
considered by the document i.e. the certificate issued by the
Circle Officer on or before 04.12.2019. There would not be any
difficulty to find out as to whether amongst the petitioners, there
are E.B.C. candidates and they got cut-off-marks. On the basis
of such exercise, the successful candidates may be recruited as
per their merit in E.B.C. Category.
13. Therefore, this Court finds that for the fault in the
advertisement in describing the Reserved Category Candidates,
the innocent candidates cannot suffer.
14. For the reasons stated above, the instant writ
petition is allowed on contest.
Patna High Court CWJC No.12606 of 2025(4) dt.07-01-2026
7/7
15. The Bihar Staff Selection Commission, Patna is
directed to carry out the exercise and come to a finding as to
whether the petitioners belong to E.B.C. category or not and
secondly, whether they got the cut-off-marks or not. On
satisfaction of the said two points, the successful candidates
shall be appointed as per the merit list.
16. This order is made under the peculiar facts and
circumstances of this case and this order cannot be used as a
precedent in future.
