The court directed the Examination Controller of B.R.A. Bihar University to dispose of the pending representation within one month, after hearing, and to pass a reasoned order.

Summary

The Vishun Rajdeo Teacher Training College filed a writ petition seeking that Bihar University send the names of students for 44 vacant M.Ed. seats, allow the college to conduct an entrance examination for the 50‑seat intake, and direct the university to dispose of a pending representation dated 5‑December‑2025. The college argued that the pending representation should be decided within a fixed time after a hearing. The university and the National Council for Teacher Education raised no objection to the limited prayer. The Patna High Court, with the parties' consent, disposed of the writ by directing the Examination Controller of Bihar University to dispose of the pending representation within one month of the order, after hearing the petitioner, and to issue a reasoned final order. If the petitioner is found entitled to the relief, the court ordered that the relief be extended within a further month.

Issues considered

  • Whether the High Court can direct the university's Examination Controller to dispose of a pending representation within a specified time frame under writ jurisdiction.
  • Whether the petitioner is entitled to the admission seats and the conduct of an entrance examination for the M.Ed. course.
